Why you should bring a legal claim

We understand that this seems a scary thing to do, particularly if you are feeling vulnerable and exposed by a new diagnosis and an uncertain future.

Making a claim

You may not wish to bring a claim immediately, but your family may think very differently. Equally, should the affected person pass away, the Coroner will want a record of a person’s asbestos exposure to assist with their investigations into the prevalence of industrial disease in their constituency, and a detailed statement in life will ultimately assist with the inquest process. The hardest part of the claim is usually the giving of the statement, because that involves information only the person affected can give. However, once the statement has been taken and signed control of the claim can be given to another family member to assist with the paperwork, leaving the sufferer free to continue with their lives and not worry about the claims process as it goes through the system. 

Seeking advice as soon as possible

It is vital you seek advice from one of our panel solicitors as soon as you can. You should not wait for the outcome of your benefits application, as the solicitors will use information from your hospital consultant to confirm the medical position. There are also very strict time limits to bringing a legal claim. The sooner you seek legal advice the better your solicitor has to investigate and prepare your case, maximising the chance of seeing your employer held to account.
